At Injury Consultants, PLLC, we protect your personal and health information during Independent Medical Examinations (IMEs) and Expert Witness Consultations in compliance with HIPAA, Washington state law (including RCW 51.36.070), and other standards. IMEs and consultations do not create a traditional doctor–patient relationship; information is used solely for evaluation and reporting in legal or claims contexts.
We collect only what is necessary: your name, contact details, medical history, claim documents, and injury-related records. These may come from you, healthcare providers, the Department of Labor & Industries (L&I), or other authorized sources, and are obtained with your consent or as required by the claims process.
Your information supports impartial evaluations, report preparation, and communications related to your IME or consultation. For workers’ compensation claims, it helps assess medical conditions, treatment needs, and work impacts. We do not use your information for marketing.
We disclose information only when required to provide services or by law. This may include sharing IME reports with L&I, self-insured employers, legal representatives, or insurers. While disclosures are protected by confidentiality agreements when applicable, once released (e.g., to L&I), the information may be subject to re-disclosure and may no longer be fully protected under HIPAA. Companions present during examinations must agree to maintain confidentiality.
